Federal Judge Blocks Key Parts of Trump's Election Executive Order
US District Judge Indira Talwani ruled Tuesday that key provisions of President Donald Trump’s executive order on elections are unconstitutional, blocking the administration from enforcing nationwide requirements for voter citizenship verification and mail-ballot restrictions. In a decision for a federal court in Boston, Judge Talwani concluded that the president lacks the authority to unilaterally impose election administration mandates on states without congressional approval. The ruling targets directives aimed at the upcoming November midterm elections.
The order encompasses directives sent to federal agencies, including mandates for the US Postal Service to assist in creating citizenship lists and limitations on mail voting for federal elections. The decision affects up to two dozen states and local jurisdictions that challenged the order in federal court. In a related development, a separate federal court ruling dismissed Monday ordered the dismantling of the SAVE voter-verification system, concluding the centralized database containing Social Security and citizenship data violated federal privacy laws and interfered with voting rights.
