Jury Finds Musk's OpenAI Suit Time-Barred After 90 Minutes, Easing IPO Uncertainty
A federal jury on Monday found Elon Musk waited too long to bring his lawsuit against OpenAI, Sam Altman and other defendants, unanimously concluding after about 90 minutes that his three claims were barred by the statute of limitations after a three-week trial. Judge Yvonne Gonzalez Rogers agreed with the finding, and Musk's lawyer Marc Toberoff signaled an appeal.
Musk's case challenged OpenAI's shift from a nonprofit to a for-profit business and alleged the company had abandoned its charitable mission. But the outcome was procedural rather than a decision on that core question: the court did not rule on whether OpenAI breached its mission, and Microsoft was found not liable on the claim Musk brought against it. The decision removes a significant uncertainty for OpenAI as it prepares for a possible IPO this year.
